Strengthen the consultation process on all major resource and energy projects to ensure Indigenous interests are paramount.

Active Status

The status is Active. Responsive activity is implemented in federal impact assessment, federal energy regulation, provincial environmental assessment, and Indigenous-led major-project standards. The Impact Assessment Act and IAAC policy and guidance materials require Indigenous participation, Crown consultation, Indigenous knowledge consideration, and assessment of impacts on Indigenous rights and interests.¹,²,³ CER processes also provide Crown consultation and Indigenous advisory mechanisms for federally regulated energy projects.⁴,⁵ British Columbia’s environmental-assessment process includes consensus-seeking, Indigenous participation, and tools for Indigenous-led assessment.⁶ Indigenous-led standards from the First Nations Major Projects Coalition further define what stronger consultation should look like from a First Nations perspective.⁷ These mechanisms are active, although they do not create one national rule making Indigenous interests paramount across every major resource and energy project.
